Phelps Won't Face Marijuana Charge

COLUMBIA, S.C. (Feb. 17) - Michael Phelps hardly emerged unscathed after a photo surfaced showing him smoking from a marijuana pipe: It cost him a major endorsement and a three-month competition suspension. But the Olympian said he's focused on swimming again now that he won't face drug charges.
A South Carolina sheriff said Monday that there wasn't enough physical evidence to charge the 14-time gold medalist.
Phelps said in a statement issued after the decision that he looks forward to diving back into the pool after the ordeal.
"For me, it's all about recognizing that I used bad judgment and it's a mistake I won't make again," the statement said. "For young people especially — be careful about the decisions you make. One bad decision can really hurt you and the people you care about."
The photo showed Phelps smoking from the pipe — known as a bong — at a party in November when he visited the University of South Carolina. However, Richland County Sheriff Leon Lott said Phelps never admitted to smoking marijuana.
"He never said, 'I smoked marijuana.' He never confessed that," the sheriff said.
Holding a bong is not a crime, he said.
"They're sold in stores. We're kind of sending a double message," Lott said. "You can buy rolling papers at any convenience store in the world, but we're telling kids not to smoke dope."
Phelps has already suffered because of the photo — USA Swimming suspended him for three months in the wake of the photo, and Kellogg Co. said it would not renew its endorsement deal with him.
And while the swimmer won't face any charge, eight people were arrested during the investigation when a small amount of marijuana was found in raids on two homes. The bong was found in a car.
Seven people have been charged with simple possession of marijuana, which carries a maximum penalty of 30 days in jail or a $575 fine. Another person was arrested for driving under suspension.
The sheriff, known for his tough stance on drug crimes, said ignoring the photo would have sent a message of tolerance.
Phelps' "bad decision and the highly published photo placed me and the Richland County Sheriff's Department in a no-win situation. Ignore it and be criticized or address it and be criticized. I chose to do what was right," said Lott, a Democrat first elected in 1996.
Lott rose from patrol officer to captain of the narcotics division in the early 1990s. He was well-known in the county for wearing stylish suits like the drug agents on "Miami Vice" and driving a Porsche seized from a drug dealer.
The sheriff said the investigation involved two narcotics officers that logged 25 hours over about a week. He said the house where the November party took place and another suburban home near Columbia had previously been investigated for drugs.
His investigation was criticized in newspaper editorials, on talk shows and by defense attorneys who questioned whether the sheriff was being overzealous because of Phelps' celebrity status.
Even if the sheriff had the evidence needed, he acknowledged he could not force Phelps to return to South Carolina to face a misdemeanor possession charge.
One of the attorneys representing the three students arrested said the accused were all in their early 20s. Attorney Dick Harpootlian said police kicked in the doors with guns drawn during the raids and found less than a cigarette's worth of marijuana in the house where the party was held. The other raid netted about four or five cigarettes' worth, Harpootlian said.
The lawyer expects his clients to either have the charges dismissed or for them to get a conditional discharge, which allows an offender to avoid punishment as long as they comply with certain conditions for six months and stay out of trouble.
"We hope these kids are treated the same as any other kids," he said.
The photo surfaced in the British tabloid News of the World on Feb. 1. The swimmer, who won a record eight gold medals at the Beijing Games, never disputed its authenticity.
Lott said the person who took the photo sold it for $100,000. He would not identify the photographer or say how he knew the amount.
The party occurred nearly three months after the Olympics while Phelps was taking a break from training.
This isn't the first embarrassing episode for Phelps after an Olympic triumph. In 2004, a few months removed from winning six gold and two bronze medals in Athens, the swimmer was arrested on a drunken driving charge at age 19. He pleaded guilty and apologized for the mistake.

The War on Marijuana has be going on now for 70 years. More people smoke pot today, by percentage, than in 1937. Presently the usage of marijuana is about the same as cigarettes among teenagers. Is that called success? The only thing wasted is tax money. We are paying far more taxes today because the prohibition of marijuana. All the wasted money on enforcement, judicial, and prison systems. Also all the lost tax monies by not taxing it. Talk about waste in government. The tax monies would be better on education and PR campaigns. It is well known that Al Capone was a big supporter of the prohibition of alcohol. Why? There's a lot more profit to made in the untaxed market. There's so much profit that Capone bribed numerous politicians and law enforcement officials. Presently the drug cartels are controlling the production and sale of marijuana, not our government. I never heard of drug dealer asking a kid for ID. Times are tough, the economic crisis today is compared to that of the Great Depression, and what paid for the New Deal that helped pull the country out of that crisis, the end of prohibition of alcohol. Also let it be noted that the baseball great, Babe Ruth, was drinking illegal alcohol throughout his career. He played from 1914 to 1935, prohibition of alcohol was from 1920 to 1933. Isn't he in the Hall of Fame? It's now the time to end the prohibition of marijuana.

AND the drug companies would totally freak because then our cancer patients would be able to afford pot or grow their own if it was legal. It is a shame that cancer patients can not afford medical marijuana. It should be legalized. It has many medical uses from glaucoma to emphysema, cancer and many other medical uses. And one more thing, LEAVE PHELPS ALONE.

Let me get this straight, he state of SC has TWO sets of laws...one for celebrities and "heroes" (I beg to differ on the sheriff's definition of Phelps as a 'hero" - wouldn't want MY kids emulating his behavior) and another set of laws for the rest of us, and determined not by the laws themselves but at the discretion of who the Sheriff likes or doesn't like...hmmm, don't think that's the way it's suppose to work...aww, phelps lost his million dollar deal with Kellogg and that's punishment enough in this economy...welcome to the AMrican Justice System's double standard! Phelps is no hero he is a lawbreaker...until the law CHANGES, which maybe he should have the presence of mind to HELP change...oh that's right he can't, he's stoned!

LAY OFF THE POT PEOPLE. GO AFTER THE ALCOHOL THAT LEAVES YOU UNABLE TO EVEN STAND ON THEIR OWN 2 FEET AND GO AFTER THE CRACK HEADS AND METH ADDICTS THAT COST US MILLIONS EVERY YEAR. GET REAL. POT WAS HERE AND IN USE IN BIBLICAL TIMES. DEAL WITH IT. IF YOU DRINK ALCOHOL THEN JUST SHUT UP ABOUT POT BECAUSE YOU HAVE NO BUSINESS TALKING, OR BREATHING.

Its easy to see that Sheriff Lott has not got much to do. Yes he is an idiot and people do make fun of him. You should meet his family. they are a scary lot(t). He runs on the Baptist anti black and white thugs,but mostly blacks; whom he hates with a vengance. Meet some of his deputies Curly , Moe and Bubba. Not a brain in the lot(******* a shame that Law Enforcement has to be represented by there Stone Age Throwbacks. They love the bible but have never read a book in their lives. Did you know that Sheriff Lott has an IQ of 99? Shows you what the City of Columbia and the surrounding area is like. Not one of his Deputies passed the written test for the South carolina State Police. They are all "Police Dropouts" Get a life dummies.
