NFL Receiver to Plead Guilty to DUI Manslaughter Charge

MIAMI (June 15) -- Cleveland Browns wide receiver Donte' Stallworth has agreed to plead guilty to a DUI manslaughter charge and would do some jail time for a Miami car crash in which a pedestrian was struck and killed, authorities said Monday.
Stallworth, 28, is scheduled to appear Tuesday in a Miami courtroom to enter the plea. If accepted by Miami-Dade Circuit Judge Dennis Murphy, Stallworth would serve a short jail sentence for the March 14 crash, followed by lengthy probation and numerous conditions, Terry Chavez, spokeswoman for the Miami-Dade State Attorney's Office, told The Associated Press.
Miami Beach police said Stallworth was drinking at a bar in the swank Fountainebleu hotel. He left to go to a nearby home—he owns three properties in the Miami area—and then headed out in his black 2005 Bentley on MacArthur Causeway, which links the beach to downtown Miami.
Prosecutors say Stallworth hit 59-year-old Mario Reyes, a construction crane operator who was rushing to catch a bus after finishing his shift around 7:15 a.m. Stallworth told police he flashed his lights in an attempt to warn Reyes, who was not in a crosswalk when he was struck.
Chavez said Reyes' family has been pushing hard to resolve the case.
"We have been in intense negotiations for the past couple of days," Chavez said. "We always take the victim's wishes into account."
Stallworth had faced up to 15 years in prison on the DUI manslaughter charge, but the plea deal calls for far less time. Chavez would not provide details on the penalties, nor would Stallworth attorney Christopher Lyons.
"There is a plea agreement and it's going to be presented to the judge," Lyons said.
Stallworth had a blood-alcohol level of .126 after the crash, well above Florida's .08 limit. He had previously pleaded not guilty and Lyons initially pledged to mount a vigorous defense.
But Stallworth has also has cooperated with investigators and issued a statement shortly after the crash expressing sympathy for Reyes' family.
"He's shown remorse and taken responsibility from day one," Chavez said.
Stallworth stopped after the crash and immediately told officers he had hit Reyes. Police estimated Stallworth was driving about 50 mph in a 40 mph zone.
Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He also has played for New England, Philadelphia and New Orleans.
The National Football League has said it will review the matter for possible disciplinary action after the legal case is completed.

you must be a drinker and a driver, yes? if the victim was one of your friend's or relative's, you would feel the exact same way, yes? here's a question for you. if the driver had not been drinkink and driving, could he avoided hitting the man, jay walking or not? here's two thing's you seem to forget. # one, pedestrian's have the right of way at all times, # two, drinking and driving is againt the law period! the .08 gauge is simply a standard to estimate the amount of alcohol in the system. when there's injury or death in an auto accident it does not apply. the man died and your trying to justify it by asking stupid question's.

You and I would get 2 yrs in prison....MINIMUM......for a first offense........I hope the victims family sues for everything he owns now AND in the future.......I hate drunks.

sameo-sameo sportsfan's. there's rich man's justice and poor man's justice and there ALWAY'S will be. when o.j. simpson beat the double murder rap in l.a., that underlined the saying. this guy was driving DRUNK, hit a man and killed him. then, the infamous "wrist slapper" arrived from calif. and applied his skill's to the sentenceing verdict. get used to it for it will never change. vick will be playing for some team somewhere and people will pay to see this punk demon apply his skill's. o.j. finally got his which completely surprised everyone especially me!

and people wonder why they are upset with the criminal justice system in this country. if you are a professional athlete, no matter the venue/state/city you live under a totally different set of rules than the rest of the population. he pleads guilty, blew a .126 and will get LIMITED jail time. this scumbag should be going to prison for the maximum allowed by the statuate. prison, not jail... felons go to prison, they do not serve a little time in the county jail. this is a travesty.. but, expect the same form of justice to come out of nyc with the other piece of ghetto trash, burress.. there is no justice for the family of the victim..... thanks miami for restoring our faith in the system. the prosecutors should have to serve the remainder of his time, IN PRISON, where he belongs...

What about the jaywalking law? If this Reyes guy was running across the street outside of a crosswalk with a car coming down the street and got hit...does it matter if the driver was drinking? What if his blood alcohol level was .08, would he still be facing charges?
