Bengals Jason Shirley Found Guilty of DUI Despite His Interesting Defense

The Bengals Jason Shirley isn't a famous football player (he doesn't get to play), but his trial for DUI is quite interesting.

To recap: last October while he was at Fresno State, Shirley was arrested for driving his car into an apartment building and then driving off. Turns out that he shockingly failed a breathalyzer test.

Despite the Bengals' claim to stay away from problem players, they decided to draft him several months later.

In Shirley's first trial, Fresno State coach Pat Hill took the stand and testified that Shirley suffered a concussion during a game against Nevada. The defense was that the concussion caused Shirley to make these bad decisions. That ended in a mistrial.

Training camps are underway, the NFL season is a month off, and to get you ready for 2008, FanHouse previews all 32 teams, "heat index" style. We'll rate each club in 10 categories on a scale of 1 to 10, high score wins.

Quarterback: If there is one constant on this team, it is Carson Palmer. Sure, Palmer didn't have his best season a year ago, but his off seasons are better than many QBs best years. In reality, other things factored into his poor season (injuries to the line, injury to Rudi Johnson, receivers pouting). The only issue here is what happens in Cincinnati if Palmer gets hurt. They have no one groomed to come in. Ryan Fitzpatrick and Jeff Rowe are in their second seasons with the team and Carson's brother, Jordan, is fighting for a spot. Heat Index: 8

Running backs: Injuries have hurt this unit in the past couple of years. Workhorse Rudi Johnson finally hit a wall; Kenny Irons blew out his knee in his first preseason game; Chris Perry has never been able to stay on the field. Well, Rudi and Perry are healthy again, with 2007 surprises Kenny Watson and DeDe Dorsey around to give the offense a different dynamic. Cincy needs this unit to get back to form to allow the entire offense to explode. Heat Index: 4

Receivers: Chad Johnson and T.J. Houshmandzadeh are one of the best receiving combos in the NFL. T.J. tied for the lead in receptions; Chad was third in receiving yards. However, this could be the last season either is in Cincinnati. Johnson's issues with the team are well documented. T.J. is in his final contracted season. Chris Henry is finally gone and there are several guys trying to step into that #3 spot. Rookie Jerome Simpson will get a strong look, as will Andre Caldwell and Antonio Chatman. Chatman is the only one with experience and could get the nod. Heat Index: 8

Bengals' Shirley to Miss Minicamp to Tend to Legal Matters

Bengals rookie Jason Shirley will likely miss the Bengals' minicamp in order to tend to some legal issues. Shirley has been on trial for a drunk driving incident which saw him plow his car into an apartment complex.

Well, a mistrial was declared after the jury couldn't reach a verdict ... meaning the case will be re-tried at the end of the month. Jury motions begin next week (and so does the Bengals' minicamp).

Shirley faces three misdemeanor counts: DUI, driving with a blood-alcohol level of 0.08 or higher and hit and run. He also has a hearing on a fourth charge of driving on a suspended license.

This is a shame because the Bengals really need their new guys in this camp (especially the defensive ones). Also, the purge of the bad apples in the offseason was supposed to signify a new way in Cincinnati. Of course, Shirley was still in college when this happened so the team must be understanding with this situation since they knew of it when they drafted him.

Bengals Draft Pick Uses a Concussion as Defense for Driving Into an Apartment Complex

You may remember there was some buzz when the Bengals drafted Fresno State DT Jason Shirley. Shirley, up to that time, was best known for driving drunk and smashing his car into an apartment building.

Well, the court case for that incident has started (Shirley faces four misdemeanor charges) and the defense seems to suggest that a concussion he suffered during a game may have contributed to all of this.
Dr. William Carveth, an official team doctor the past three seasons, testified that the concussion Shirley sustained days before he drove a car into a townhome complex in the late night hours of Oct. 8 could have compounded the effects of the alcohol he drank that night and affected his decision making, emotional stability and ability to follow directions.

Carveth met with Shirley on the afternoon of Oct. 8, two days after Shirley sustained a concussion in the Bulldogs' game against Nevada. At that time, Carveth reported Shirley had "a mild, if any, concussion."

Now, that second paragraph is interesting. October 8th was the night that Shirley plowed his car into that apartment building. In more testimony, Carveth stated that Shirley continued to have pain and ... a month later ... Carveth wrote a letter to the school saying he had a "moderate" concussion (Shirley was trying to get reinstated to Fresno State).

The defense also brought out Fresno State head coach Pat Hill, two FSU basketball players and a track and field athlete. They also had the apartment complex manager state that the lights around the accident scene had been out.

As I type this, the case is in the jury's hands.

This isn't a post as much as it is a running page to document some of the difficulties this Bengals organization has had.

Was There a Little Draft Day Rivalry Between the Saints and Bengals?

I know that jockeying for position, strategery, deception, and manipulation are all par for the course in the NFL draft. So it's not exactly a head-turner when one team jumps ahead of another for a player they're both interested in. Three players, however, is a tad more interesting.

The Saints and Bengals both came into the draft with comparable needs, and the two coaching staffs have some sort of friendly bond, pairing together last summer for a couple of training camp scrimmages. But yesterday played out like a consistent bit of dueling, and the Saints won all three times.

The obvious battle was the one for Sedrick Ellis. It was no secret that both teams were gunning for Ellis, and the Saints beat the Bengals to him. The Saints then traded to move up two spots in the fifth and drafted defensive tackle DeMario Pressley right in front of the Bengals, forcing them to draft fellow tackle Jason Shirley, he of alcoholic infamy. Obviously the Bengals got flustered by the Saints thievery and took Shirley because he was the right position, if not the right personality. Finally, the Saints identified a player in the seventh who wouldn't reach them in free agency and traded a '09 pick to grab receiver Adrian Arrington. The next receiver taken? Mario Urrutia from Louisville, just seven picks later by -- you guessed it -- the Bengals.

It just seems a little too coincidental, doesn't it?
